BCA identifies man and officer involved in Rochester force incident

ST. PAUL — The Minnesota Department of Public Safety’s Bureau of Criminal Apprehension (BCA) has identified the man involved in the use-of-force incident in Rochester on June 29 as Luis Enrique Ovalle, 29, of Rochester. Ovalle was not injured in the incident.
The BCA has also identified the Rochester Police Department officer who used force during the incident:
• Officer James Perry discharged his firearm. He has 10 years of law enforcement experience. The Rochester Police Department has placed him on critical incident leave.
According to the BCA’s preliminary investigation, Officer Perry attempted to stop a white Dodge Caravan being driven by Ovalle just after midnight on June 29. Ovalle did not stop and instead fled out of sight.
Officer Perry had previously responded to a call just before 11 p.m. in which a caller identified Ovalle and reported that he was intoxicated and armed with a knife outside a residence. Ovalle left the scene before officers arrived.
Officer Perry later located the Dodge Caravan at a known address for Ovalle on the 2700 block of First Avenue Southwest. When he activated his emergency lights and gave commands, Ovalle exited the vehicle with a rifle. Officer Perry discharged his firearm once, and Ovalle retreated into the home with the rifle. Following a standoff, Ovalle surrendered peacefully.
BCA crime scene personnel recovered a spent casing and a replica rifle. Officers were wearing body cameras during the incident, and BCA agents are reviewing the footage as part of the active investigation.
The Rochester Police Department requested the BCA investigate the officer’s use of force. Once the investigation is complete, the BCA will present its findings without recommendation to the Olmsted County Attorney’s Office for review.
The incidents leading up to the use-of-force are being investigated by the Rochester Police Department.
