BCA identifies officers who used force in Bloomington incident

ST. PAUL – The Minnesota Department of Public Safety Bureau of Criminal Apprehension (BCA) has identified the Richfield police officers who used force during the July 5 incident in Bloomington.
- Carter Johns fired his department rifle. He has 10 months of law enforcement experience and is on critical incident leave.
- Bryan Rosas fired his department handgun and used less-lethal force. He has four-and-a-half years of law enforcement experience and is on critical incident leave.
- Sgt. Patrick Sheady used less-lethal force. He has 10 years of law enforcement experience.
According to the preliminary investigation, just after midnight on July 5, Richfield officers responded to a call of a suicidal man in Bloomington. The man, later identified as Andrew James Maxwell, 36, of Bloomington said he was in the garage and had a shotgun. When the officers arrived at the home, they saw the garage door start to go up and Maxwell came outside, holding a shotgun. Rosas fired less-lethal rounds at him and Maxwell shot at the officers. That's when Johns and Rosas returned fired. No one was injured during the exchange of gunfire. Maxwell then went back into the garage and closed the door. Richfield SWAT responded and at one point, Sgt. Sheady fired 40mm rounds at Maxwell. The officers took him into custody when he left the garage. Maxwell was taken to the Bloomington Police Department where he was examined and cleared by medical personnel while awaiting charges.
BCA crime scene personnel recovered cartridge casings and shot shell casings at the scene. There is both body-worn and squad car camera video of this incident. BCA agents are reviewing all available video as part of the active investigation.
The Richfield Police Department asked the BCA to investigate this incident. Once the investigation is complete, the BCA will present its findings without a charging recommendation to the Hennepin County Attorney's Office for review.
