BCA update on off-duty officer shooting

ST. PAUL — The Minnesota Department of Public Safety Bureau of Criminal Apprehension (BCA) is investigating an incident involving an off-duty Minneapolis police officer and a family member who both fired handguns on Tuesday, June 20 in Minneapolis. This investigation is active and on-going.
- The off-duty officer fired a personal handgun and is on standard administrative leave. His identity is protected under Minnesota Statute 13.82, subdivision 17.
According to the initial investigation, the off-duty officer woke up to find his relative, Ernesto Del Villar, 30, of Minneapolis pointing a gun at him. Both men fired shots during the incident but no one was injured. The officer retreated to safety on a second story roof. After some negotiation with the Minneapolis Police Crisis Negotiations Team, Del Villar surrendered peacefully. He remains in custody on pending second-degree assault and domestic assault charges.
BCA crime scene personnel recovered three handguns and several cartridge casings at the scene. Because the officer was off-duty, he was not wearing his body camera. BCA agents are gathering and reviewing all available video as part of the investigation. No uniformed officers acting in their official capacity used force during this incident.
The Minneapolis Police Department asked the BCA to investigate the entirety of this incident, including the actions of both the off-duty officer and Del Villar. Once the investigation is complete, the BCA will present its findings without recommendation to the Hennepin County Attorney's Office for review.
