Statutory requirement to provide notification to victims

Notice of release

Jails are required to notify victims of violent crimes and domestic abuse of the release of an arrested or detained person. The agency having custody of the arrested or detained person shall make a reasonable and good faith effort to provide oral notice to the victim. The notification must include:

(1) the conditions of release, if any;

(2) the time of release;

(3) the time, date, and place of the next scheduled court appearance of the arrested person and the victim's right to be present at the court appearance; and

(4) the location and telephone number of the area sexual assault program as designated by the commissioner of corrections.

Written notice of points (2) and (3) above must then be personally delivered or mailed to the victim as soon as practicable.
