BCA Investigating Brooklyn Park Officer Involved Shooting

​ST. PAUL — The Minnesota Department of Public Safety Bureau of Criminal Apprehension (BCA) is investigating an officer involved shooting incident that happened on Monday, March 16, outside of the Walmart located at 8000 Lakeland Avenue North in Brooklyn Park.

The man injured during the incident, James Howard Klein, 32, no permanent address, was charged today in Hennepin County District Court with two counts of felony assault – use of deadly force against a peace officer – and one count of being a felon in possession of ammunition or a firearm.

Mr. Klein remains at North Memorial Health Hospital where he is being treated for non-life threatening gunshot wounds. No one else was injured during the incident.

In addition, the BCA has identified two officers who discharged their weapons during the incident. Both are on standard administrative leave.

  • Officer Charles Cudd has been with the Brooklyn Park Police Department for 14 years. Officer Cudd deployed his Taser and discharged his firearm during the incident.
  • Officer Dane Lazenberry has been in law enforcement for five years including one year with the Brooklyn Park Police Department. Officer Lazenberry discharged his firearms during the incident.

Two individuals who were with Klein were briefly detained and released.

BCA crime scene personnel recovered a handgun from near the spot where Mr. Klein was located. Body cameras, squad cameras and store security cameras captured portions of the incident.

When the BCA’s investigation into the officer involved shooting is complete, the BCA will provide its findings without recommendation to the Hennepin County Attorney’s Office for review.
